Building Permit Application

Anyone wishing to build, restore an existing structure, or make modifications to it must obtain a building permit.

What documents are required to apply for a building permit?

The building permit application must include:

  1. A written request on plain paper, signed by the applicant or their representative. (2 copies)
  2. A property certificate, a court judgment, or any document proving ownership of the land intended for construction. (2 copies)
  3. A construction project plan. (5 copies)
  4. A receipt of personal income tax or corporate tax declaration. (2 copies)
  5. A receipt showing payment of taxes related to the property concerned by the building permit application. (2 copies)
  6. A study detailing the minimum technical specifications for energy savings in the construction and extension of residential and office buildings, for any covered area exceeding 500 m².
    (Prepared by the project’s architect, an engineering firm, or a consulting engineer, and approved by a technical controller authorized by the Ministry of Equipment, Housing, and Territorial Development in the building sector) (5 copies)
  7. A presentation note. (2 copies)

Articles 15 and 32 to 39 of Law No. 3 of 1957 dated August 1, 1957, relating to the organization of civil status.

The decree dated August 13, 1956, issuing the Personal Status Code and its amended texts.

Organic laws related to active duty personnel, customs officers, the national army, and diplomatic agents.

✅ Conditions for Service Eligibility

Preparation of the marriage contract and signature by the concerned parties (the bride and groom – the two witnesses – the civil registrar).

Submission of a request by the concerned parties to the civil registrar, along with the required documents, based on which the marriage date will be set.

  • Birth certificate for each spouse
  • Medical certificate for marriage
  • Copy of the national ID card or another identity document for both spouses
  • Court authorization for minors
  • Written consent from the guardian if one spouse is absent
  • Death certificate of the spouse for widows or widowers
  • Copy of the divorce judgment or birth certificate indicating the divorce
  • Administrative authorization for those requiring prior declaration (active personnel, customs, army...)
  • Certificate from the consulate or diplomatic mission for foreigners
  • Certificate of conversion to Islam for non-Muslims wishing to marry a Muslim Tunisian woman
  • ID cards of the two witnesses who meet the legal conditions

Family Record Book

Family Record Book

It serves as a reference document for the head of the family whenever a civil status document is required for any family member.

The Civil Registrar of the place of marriage issues it for those who were married after 01/08/1957. For marriages before the publication of the Civil Status Law, the Civil Registrar of the husband's place of birth is responsible.

Birth

Given the importance of this event, it is governed by a set of regulations concerning the declaration, the timeframe, and the method of establishing the birth certificate.

Who declares the birth?

One of the following individuals, in descending order of priority, is required to declare the birth:

  1. The father, first and foremost.
  2. The doctor or midwife.
  3. Any person who was present at the delivery.
  4. Any other person at whose place the woman gave birth.

When must the declaration be made?

The declaration must be made within the legal deadline set by the applicable regulations (generally within 5 days following the birth, excluding the day of birth).

Who receives the declarations?

Declarations are received by civil registry officers in the place of birth.

Note: A stillborn child is not recorded in the birth register but only in the death register.

The applicant for this service must present the original of each copy to be certified to the civil registry officers. These officers are strictly required to verify the full conformity of the copy with its original.
Taxes and Fees
The certification of conformity of copies to the original is subject to fees. The amount of these taxes is set as follows:
