1. Conclusion of a Marriage Contract

Conditions:

  • Both parties must meet legal marriage requirements
  • Court permission and two witnesses are required if either party is underage
  • Written consent from a guardian with justification in case of absence, for a minor's marriage
  • Administrative authorization for professions requiring prior approval (e.g., military, diplomatic corps, security forces)

Required Documents:

  • Recent original birth certificate for each spouse
  • Pre-marital medical certificate for both spouses
  • Copy of an official identity document
  • Death certificate of the previous spouse for widows/widowers
  • Birth certificate noting divorce or divorce judgment for divorced individuals
  • Consular or diplomatic authorization confirming eligibility for marriage for foreigners
  • Certificate of conversion to Islam for non-Muslims marrying a Tunisian Muslim
  • Presentation of identity cards by the two witnesses

Procedure:

  • Submit a request with required documents to the civil status officer at the central service or a municipal office, who schedules the marriage
  • Drafting and signing of the marriage contract by the parties involved (spouses, witnesses, civil status officer)

Timeframe:

  • 2 days to 1 week
2. Birth Registration

Required Documents:

  • Provision of required information, either by:
  • Notification from a witness to the birth
  • Birth certificate from the hospital or clinic
  • Or anyone who witnessed the birth
  • Or identity documents of the parents (e.g., ID card, family booklet, or a sibling’s birth certificate)
  • Signature of the informant in the birth register

Note:

  • Documents ensure accurate recording of family names

  • Submit a request with required details to the civil status officer, who records the birth in duplicate

  • Hospital or clinic director or the owner of the place of death, within 24 hours
  • Prison director (immediate reporting)
  • National security forces for deaths due to traffic accidents, execution, or violence (immediate reporting)
  • For deaths abroad, contact the consulate or embassy

Notes:

  • Civil status documents are issued only to the deceased’s relatives, guardian, or legal representative
  • Prosecutors can access records
  • Court permission is required for others
4. Issuance of Death, Marriage, or Birth Certificates

Conditions:

  • Submit a request

Required Documents:

  • Details of the record (number, year, day)
  • Or civil status document specifying whether it is an original record, declaration, or judgment for birth certificates
  • For marriage certificates, specify if concluded at the municipality or with notaries
  • Payment in cash or postal order to the municipal receiver, with a stamped envelope bearing the applicant’s address if mailed

Procedure:

  • Submit a request with details or a civil status document to the civil status officer, specifying for birth certificates whether it is an original record, declaration, or judgment, and for marriage certificates whether concluded with the civil status officer

Notes:

  • Certificates are issued to the record holder, their relatives, guardian, legal representative, or spouse (if not separated or divorced). Provided free to prosecutors and administrative services

  • For suspicious or violent deaths, burial authorization requires a police report

Procedure:

6. Issuance of Family Booklet (First Time or Replacement)

Required Documents:

  • Photo of the family head (optional)
  • Marriage certificate
  • Birth certificates of both spouses
  • Certificates of other family members (for replacements or updates)
  • Death certificate of the spouse for issuance to the mother
  • Divorce judgment for the custodial ex-wife
  • Applicable fees for the family booklet

Procedure:

  • Submit a request with documents to the civil status officer in the municipality where the marriage was concluded
  • For marriages before the 1957 Civil Status Law, the booklet is issued at the husband’s birthplace

  • Falsifying booklet information is punishable by 1 year in prison and a 240-dinar fine
7. Signature Authentication

Conditions:

  • The document submitted for signature authentication
  • Must not violate ethics or public order
  • Must be written in Arabic or a language commonly used by the administration
  • The applicant must have legal capacity to sign
  • Must present an official identity document
  • Must sign in person before the officer (except for pre-registered signatures)

Note:

  • For illiterate or incapacitated applicants, the document is read aloud in the presence of two trusted witnesses with IDs, recorded in the register

Required Documents:

  • Document to be authenticated
  • Official identity document (e.g., ID card, passport)

Procedure:

  • Submit the document for signature authentication
  • Sign immediately in front of the administrative officer responsible for authentication
  • Record details in the official register, with the applicant signing next to the document’s recorded details
  • Pay the fees, receive a receipt, with a note on the authenticated document
  • Affix necessary details, stamps, and date on the document
  • Officer signs with their identity and position noted

8. Certification of Copy Conformity

Conditions:

  • The document submitted for certification of conformity must not violate ethics or public order
  • The document must be written in Arabic or a language commonly used by the administration

  • Copies to be certified

Procedure:

  • Verify complete conformity between the original and the copies to be certified
  • Affix a specific stamp on the certified copies
  • Record all required details in the certified copies or a dedicated register (document summary, date, fees, officer’s identity and position)

Civil Status Extracts

Since obtaining a certified copy of the record or direct access to the register by third parties may cause moral harm to the holder of the record or their beneficiaries, the legislator has defined conditions for obtaining civil status documents.

Obtaining Civil Status Documents

Copies of the record or extracts from it may be obtained depending on the status of the requester.

A certified copy or extract of civil status records (birth, marriage, death) can only be obtained by the record holder, their direct ascendants or descendants, their spouse (not divorced or legally separated), their guardian or legal representative if they are a minor or incapacitated, or the public prosecutor. Any other person must obtain authorization from a judge.

  • The application for a duplicate family record book may be submitted by a divorced woman who has not remarried and has been granted custody by court ruling.
